Jeremy Phillips KC (Door Tenant)

Jeremy has been addressing issues of individuals’ fitness and propriety for more than four decades; it is an area to which he brings a wealth of experience to assist those at risk of losing licences and livelihoods. This experience covers a range of sports including horseracing, athletics, tennis, archery, paralympics and swimming, along with having acted in professions relating to the casino, minicab (PHV), sex entertainment, nightclub, pub and security industries.

Counsel has appeared before tribunals and courts at all levels. He also sits on the Lawn Tennis Association Disciplinary Panel, the British Equestrian Foundation Panel and the Professional Conduct Panel of the Teaching Regulation Agency.

Jeremy brings a wealth of experience to licensing issues, ensuring he has been perfectly placed to assist with novel licensing issues in the UK and abroad.

Ably advising on complex issues, Counsel regularly advises on the likely implications of developing legislation affecting alcohol, entertainment, gambling licences amongst others. He has received recognition for his work representing a wide range of clients from hotels, nightclubs, restaurants, and supermarkets to assisting the police and licensing authorities with contesting applications.

Counsel is Editor in Chief of Paterson’s Licensing Acts and General Editor of Smith & Monkcom – The Law of Gambling and has written or contributed to numerous other publications in the field.

Having co-authored The Law of Regulatory Enforcement and Sanctions: A Practical Guide (OUP) with Julie Norris, Jeremy has an enviable knowledge of issues including food, waste and health & safety breaches. He has represented the Environment Agency, Health and Safety Executive, Marine Management Organisation and Local Authorities in inquests and prosecutions. In the field of statutory nuisance, he has combined his expertise in mediation to resolve to the satisfaction of all parties long-standing significant cases blighting local authorities and the communities they represent.

Jeremy has acted in the High Court in a wide range of public law issues. He has also contributed to the work of the Law Commission, Department of Culture Media and Sport, Cabinet Office and former Department for Business Enterprise and Regulatory Reform. Further he has assisted the Bar Counsel, its Ethics committee, and the Licensed Trade Charity, for whom he is a trustee and school governor.

Jeremy’s expertise and versatility is evidenced in the broad spectrum of cases which he has successfully resolved in this area. Ranging from various Town and Village Green planning inquiries, to successfully pursuing objections to the development consent order (DCO) for the 4.1bn Thames Tideway Tunnel infrastructure project, Counsel is sought after for his handling of particularly sensitive cases through to conclusion. Other notable instructions include representing the Ramblers Association in relation to the Bristol Bus Rapid Transit Scheme and supporting the successful Weymouth Relief Road and South Devon Link Road.

Most recently he has advised the Manchester Arena Inquiry, of which Volumes 1 and 2 of the Report has just been published by the Chairman, Sir John Saunders.

Counsel is committed to the benefits of meditation as a method for resolving potentially complicated and expensive disputes. His success and finding a mediated resolution in cases including a long running dispute concerning noxious odours from a city-centre manufacturing business, a regional waste landfill site and a landowner -v- regulator dispute regarding flood defences, highlight Jeremy’s skill in this area.

Engaging in mediation even on such complex matters can drastically reduce the time frame and cost of such disputes. It also offers a wider range of solutions beyond those that could ordinarily be derived from a court.
